These Terms of Use govern your use of the MsgGenie website and services. By accessing the website or using our services, you agree to these terms. If you use MsgGenie on behalf of an organisation, you confirm that you have authority to bind that organisation.
Our service
MsgGenie provides business messaging tools and related support. Current and future capabilities, including integrations and availability, may change. A separate order form, subscription agreement, or data processing agreement may apply to paid services; where there is a conflict, that agreement controls.
Account and acceptable use
You must provide accurate information, protect account credentials, and promptly notify us of unauthorised access. You must use the service lawfully, respect applicable messaging and privacy laws, and comply with relevant channel policies, including Meta and WhatsApp policies. You may not send unsolicited, unlawful, deceptive, harmful, or infringing content; interfere with the service; or attempt unauthorised access.
Messaging responsibility
You are responsible for the messages, contacts, templates, and other content you submit, as well as for obtaining all necessary notices, permissions, and consents. You must honour opt-outs and other customer rights. We may suspend access where we reasonably believe use violates these terms, law, or channel policy.
Fees and third-party charges
Fees, payment terms, and any applicable usage charges will be set out in your commercial agreement. Third-party providers and communication channels may impose their own fees or rules, which may change independently of MsgGenie.
Intellectual property
MsgGenie and its content are protected by intellectual-property laws. Subject to your agreement and payment of applicable fees, we grant a limited, non-exclusive, non-transferable right to use the service for your internal business purposes. You retain rights in your content.
Disclaimers and liability
The website and service are provided on an “as available” basis to the extent permitted by law. We do not guarantee uninterrupted, error-free, or channel-independent operation. To the maximum extent permitted by law, MsgGenie will not be liable for indirect, incidental, special, consequential, or punitive damages. Any direct liability is limited as set out in the applicable commercial agreement.
Termination and changes
Either party may end a service relationship as permitted by its applicable agreement. We may update these terms from time to time; continued use after the effective date indicates acceptance. Questions may be sent to legal@msggenie.in.
